Longtime Madoff employee admits decades of fraud

NEW YORK (Reuters) - One of Bernard Madoff's longest-serving employees pleaded guilty on Thursday to falsifying records, a conspiracy that a prosecutor said began in the 1970s at the start of the multibillion-dollar Ponzi scheme.

Irwin Lipkin, 74, a former controller of Bernard L. Madoff Investment Securities LLC, told a Manhattan federal court judge that for years he fudged the books on Madoff's orders, but that at no point did he suspect the epic, decades-long fraud.

"While working for Bernie Madoff, I made accounting entries in financial records that I knew were inaccurate," Lipkin said. "At no time before I retired was I ever aware that Mr Madoff or anyone else at the company was engaged in the Ponzi scheme reported in the media."

Lipkin, who signed a plea agreement with federal prosecutors, pleaded guilty to charges of conspiracy to commit securities fraud and falsifying documents. The charges carry up to 10 years in prison.

Lipkin's son, Eric Lipkin, another former Madoff employee, pleaded guilty in 2011 to criminal charges of bank fraud and charges that he reported people were Madoff employees so they could receive retirement benefits.

Irwin Lipkin joined Madoff's firm in 1964, he told the court on Thursday. He was Madoff's first employee who was not a Madoff family member. Although he retired in 1998, he and his wife illegally remained on the Madoff payroll and received benefits but did not work, Lipkin said.

Prosecutor Julian Moore told judge Laura Taylor Swain that "as early as the mid 1970s" Lipkin had begun changing the financial records of accounts at Madoff's direction.

Madoff, 74, was charged in December 2008 with a decades-long fraud that the government originally estimated at as much as $64.5 billion. He pleaded guilty in March 2009 and is serving a 150-year prison sentence.

The trustee leading the search for money to return to Madoff's victims says Madoff defrauded customers of about $20 billion. The trustee, Irving Picard, so far has won over $9 billion in recoveries and settlement agreements.

On June 29, Madoff's brother Peter pleaded guilty to criminal charges. He had been chief compliance officer at his brother's firm. He has agreed to accept a 10-year prison term and will be sentenced in December.

Of more than a dozen people charged in the case, apart from Bernard Madoff, five have pleaded not guilty and are awaiting trial.

Among those five, Irwin Lipkin on Thursday said former investment advisory employee Annette Bongiorno had helped him falsify trading records. A lawyer for Bongiorno did not comment on Lipkin's accusations, but said "it saddens us that the government has insisted on prosecuting an elderly, very sick man, who ought to be left alone to die in his bed."

The case is U.S. v. O'Hara et al, U.S. District Court, Southern District of New York, No. 10-cr-228.

Pope resurrects Latin with academy to boost study

VATICAN CITY (AP) ? The Vatican is trying to resurrect Latin.

Pope Benedict XVI issued a decree Saturday creating a new pontifical academy for Latin studies to try to boost interest in the official language of the Roman Catholic Church that is nevertheless out of widespread use elsewhere.

Benedict acknowledged Latin's fall from grace in his decree, saying future priests nowadays often learn only a "superficial" knowledge of Latin in their seminaries. The new academy will promote Latin through conferences, publications and instruction in Catholic schools, universities and seminaries, he wrote.

As expected, the decree and its founding statutes were written in Latin.

Benedict's move is further evidence of his attempt to restore the church to its traditional roots as it battles to prevent the faithful from straying in today's increasingly secular world. Benedict has been promoting this "new evangelization" to try to reassert Christianity's place in society in parts of the world where it's fallen by the wayside, a victim of competition from Pentecostal churches and its own priest sex abuse scandals.

The initiative is also an olive branch to traditionalist Catholics, who have long lamented the modernizing reforms of the Second Vatican Council which replaced the Latin liturgy with Mass in the vernacular.

In 2007, Benedict relaxed restrictions on celebrating the old Latin Mass, a move that supporters say has increased interest in the Latin language and the Latin liturgy.

Since becoming pope in 2005, Benedict has reintroduced Latin in much of his own Vatican celebrations, with the gospel often chanted in the ancient language.

The Vatican argues that while few ordinary Catholics may understand Latin, it is a universal language that represents the universal church and doesn't favor the language of one particular group over another. Critics say the return to Latin is just another indication of how out of touch today's Catholic Church is with the modern world.

Once the kindling effect has set in, it can pose significant challenges to the recovery of the affected person. This is often evidenced by the behavior of addicts or alcoholics that try time and time again to get clean with no results except the downward spiral of destroyed relationships, careers and health. In fact, the ?revolving doors? of most drug detox centers and rehabs swing on the hinges of the kindling effect.

What this means in lay terms is that although many addiction experts expound the idea that relapse is a normal part of addiction, it?s actually a progressive, severe problem that must be arrested permanently, as early as possible. This requires educational programs, facilities, resources and infrastructure that subscribes to the notion of;

?You must stop using now and forever,? instead of ?Better luck next time, see you when you get back.?

If we look at addiction and alcoholism as the chronic and potentially fatal diseases they are, it?s easy to see that the kindling effect is equivalent to a remission of cancer, whereby each new recurrence could be the final, fatal relapse. And because addiction is our most serious public health issue, spreading the word about this condition is essential considering its relative obscurity.

Ultimately, we?ve got to start a fire about the Kindling Effect.

Cinemark shares helped by outsized 3Q results

LOS ANGELES (AP) ? Shares of theater chain owner Cinemark Holdings Inc. treaded water in a declining market Wednesday after its third-quarter earnings results blew past analyst expectations, thanks to strong international attendance and ticket pricing.

Lazard Capital Markets analyst Barton Crockett kept his "Buy" rating on the shares with a $30 price target.

He also raised his estimate for annual earnings before interest, taxes, depreciation and amortization by $9 million to $587 million, due largely to the positive third quarter.

"We see Cinemark as a play on secular growth of the middle class in Brazil and Latin America, where it is the region's leading theater chain, and growth in the U.S., where it is the third-largest chain," Crockett wrote in a research note on Tuesday.

On Tuesday, Cinemark reported third-quarter net income of 41 cents per share, beating the 35 cents expected by analysts polled by FactSet. Revenue fell 1 percent to $633.6 million, but that was still better than the $627 million expected by analysts.

Shares gained 19 cents at $25.60 in midday trading while the Dow Jones industrial average fell 2 percent, dropping below 13,000. Investors were worried about the so-called fiscal cliff of automatic spending cuts facing the newly re-elected President Obama and a Republican Congress, and a deepening recession in Europe.
